Gazetted Exemptions

The following exemptions have been made under regulation 5 of the Health and Safety in Employment (Pressure Equipment, Cranes, and Passenger Ropeways) Regulations 1999 [PECPR Regulations]:

Controllers of Timber Treatment Vessels

Date gazetted : 22/12/05

Exemption : Exempted from PECPR Regulations 10(2) and 10(3). To access the full text of the exemption, see Notice of Exemption in the New Zealand Gazette, 22/12/2005, No. 210, p. 5376.

Description : Exemption applies to controllers of timber treatment vessels, which were in service prior to 1/3/04.

Controllers of hand-held surface ropeways

Exemption: Exempted from PECPR Regulation 10(2)

Description: Controllers of hand-held surface ropeways are exempt from regulation 10(2), which requires all practicable steps be taken to ensure equipment is not operated without a current certificate of inspection, subject to the following conditions:

  1. This exemption does not apply to surface ropeways of the overhead travelling wire type (which includes Platter and T-Bar ropeways); and
  2. The exemption relates only to the type of equipment exempted.

The following exemptions have been made under regulation 6 of the Health and Safety in Employment (Pressure Equipment, Cranes, and Passenger Ropeways) Regulations 1999 [PECPR Regulations]:

Low temperature water – Pressure vessels and pressure piping

Exemption: Exempted entirely from the PECPR Regulations

Description: Pressure vessels and pressure piping used solely with water at temperature over 0ºC and not over 65ºC

Trainee equipment inspectors carrying out inspections

Date gazetted: 03/02/05

Exemption: Exempted from the requirements of the PECPR Regulations that the certificate on inspection must be issued or renewed on the recommendation of, and bearing the name of, the equipment inspector who inspected the equipment, subject to conditions.

Description: All equipment

Hoists

Date gazetted: 15/08/02

Exemption: Exempted from regulations 18, 19 and 20 subject to a condition (see description below)

Description: Powered hoists are to be exempt from the following subject to the condition specified below:

  • The requirement for design verification as per Regulation 18;
  • The requirement for fabrication inspection as per Regulation 19;
  • The requirement for design verification and fabrication inspection as per Regulation 20;
  • On condition there is a Statement of Conformity, attesting that the design and manufacture of the hoist has been assessed as acceptable, provided by one of the following Classification Societies:

    American Bureau of Shipping
    Bureau Veritas
    Det Norske Veritas
    Germanischer Lloyd
    Lloyds Register
    Nippon Kaiji Kyokai

Electrical cables subject to pressure

Exemption: Exempted entirely from the PECPR Regulations

Description: Pressure equipment being electrical power or telecommunication cables subject to pressure, such as oil or gas filled electrical cables.

Networks for the supply, distribution and discharge of water for hydroelectric installations

Exemption: Exempted entirely from the PECPR Regulations

Description: Networks for the supply, distribution and discharge of water, and associated equipment and headraces such as penstocks, pressure tunnels, and pressure shafts, for hydroelectric installations.

Certain pressure equipment fitted to heavy commercial vehicles

Date gazetted: 14/12/00

Exemption: Exempted entirely from the PECPR Regulations except for regulation 10(1)

Description: The following equipment fitted to heavy commercial vehicles:

  1. Air suspension systems
  2. Air assisted clutch systems
  3. Air horn systems
  4. Air operated locks on turntable bases
  5. Air operated securing locks used to positively lock equipment
  6. Hydraulic hoists used in tipping bodies
  7. Hydraulic or pneumatic operated lifting platforms
  8. Pneumatically operated doors on buses
